A 41-year-old company employee, Moriyoshi Inoha from Tokyo was arrested for unauthorized distribution of popular anime series using a program called Share. Inoha was arrested along with two other men, 34-year-old company employee Kasuhiro Maki from Kawasaki City and 21-year-old student Takahiro Otomo.

Share is a popular file-sharing program that promises high anonymity for its users. According to the prosecution, Inoha became well known for distributing anime through an earlier program called Winny, but later allegedly switched to Share when the developer of Winny was arrested.

The prosecution is pushing for a one-year, six-month sentence for the arrested men. Japan's Copyright Law prohibits unauthorized uploaders but expressly allows people to download for private use. The Japanese government is, however, pushing for a ban on unauthorized downloads as well, despite the protest from citizens.

With companies like ADV suffering so much, I hope countries step up. You hear 'don't download movies' 'don't download our songs' but how many people really care about anime? I admit, I've done the download, so I can't really talk, but I have a rule. I only get what I can't buy. Stupid excuse.

Anyways, it's the risk we take.

I'm with you on that. I've never really downloaded anime before, but I have viewed it on the internet (aka youtube.) when it isn't avalible here in the US. (or my family is just too poor at the time to get the DVD.)

Wow, they get longer punishment than animal abusers here in the U.S.

Anyway, back on topic. Too many companies are struggling to keep anime afloat. Tokyopop, ADV, etc. Kids and adults alike are downloading anime for free and not buying the DVD's or manga, which is quite easy to save money for... countries should step up on illegal downloading. Srsly.

No. I'm talking in general. For something that infringes copyright, or forging a check gets longer punishment than when someone takes an animals life. :/ I'm no animal rights activist, but... yeah.

If I'm Inoha, I'll sue Share. They promise for anonymity but he got caught anyway... it's about time the gov take action, if ppl keep not buying things, the company will eventually collapse and we'll have no anime...

But on the other hand, the company has to be able to see that lots of us just can't afford to buy DVDs or other stuffs... they have to lower their price... if we can buy them, we'll won't d/l them rite?

Remember, Inoha was arrested for unauthorized uploading of files, which is illegal in Japan. I presume that if a person/group has permission from the animation companies to upload their files, downloading them is pretty much free for all.

The issue of streaming and downloading in other countries is pretty much moot at this point. I don't know what Japan's stand is on fansubs/dubs or scanlations outside their country, but I'm seeing that it's mostly the English speaking companies that are fighting for a swift action on sharing files online.

My theory is this (and I would welcome any feedback or corrections, just be nice): since English speaking companies pay premium for exclusive rights to a series, they expect to sell any and all merchandise related to that series to English speaking audiences, and that's not just limited to North America or the United Kingdom. If any independent group distributes translations for free, that's huge business gone for these companies.

yeahh . so so true . if Share promised to be anonymous , then how would he get caught ? i suppose he did take the risk but still ... so many people still do it today ~ and there should be some government action .

OMG ! i never end up buying anime cuz it's expensive ... so i either settle for manga , or youtube . maybe if it weren't so expensive ... who knows ! maybe they'll give in . XD

Well, once they start showing anime's in America on television in Japanese with decent English subtitles, then maybe I'll stop dling. I used to buy my anime, but the subtitler's are usually so horrible with grammar on the DVDs you can't even understand what's going on, at least, with the anime's I've watched on DVD that were subtitled. I don't want to watch my anime in English dub, and I want subtitles I can understand, that's why I dl. =\ Or watch streamed.

Well if all illegal downloaders are to be arrested, half or most of the community will be in jail.

Set that aside, yes, this is a really good act since a lot of companies are falling.

Considering I rarely ever watch anime in general (outside of the boxsets I own), I guess I'd be pretty safe in that department. Although my habit of hitting up <mangatraders.com> anytime I get the urge to look at something new or pass the time certainly doesn't help me...
